European Court finds Turkey guilty in Inci-Yurtdas case

The applicants complained that under Article 6 (right to a fair trial) of the Convention, that their case was not heard by an independent and impartial tribunal. They also complained that they were not given access to legal assistance while in police custody and that their admissions, which were used in evidence against them, were obtained under duress.

The European Court delivered its verdict and said that the fair trial rights of the two were violated but did not seek damages from Turkey except for the court expenses.

Yurtdas was sentenced to 12-years and 6 months and Inci 3-years and 9 months imprisonment. Yurtdas is serving his jail sentence in Burdur prison while Inci has completed his sentence.
